Do you need a permit to sell homemade food in Maine?

It depends on your town and how you sell. Maine has no single statewide cottage food permit. If your city or town has adopted a Food Sovereignty Ordinance under the Maine Food Sovereignty Act (7 MRSA chapter 8-F), direct producer-to-consumer transactions and traditional foodways inside that town are exempt from state and local licensing โ€” over 100 Maine municipalities have adopted one, but there's no single official statewide list, so check with your own town office. Without local Food Sovereignty coverage, Maine's statewide home-kitchen-producer exemption (7 MRSA ยง411/ยง416) still lets you sell homemade food with no license or inspection, but only directly to an informed consumer at your own home, a farmers' market, or a traditional community social event. Selling more broadly โ€” shipping, wholesale, or retail-store placement โ€” generally means applying for a Maine DACF Home Food License instead ($20/year, initial kitchen inspection, shelf-stable/non-TCS foods only). Meat and poultry always need state/federal inspection no matter which path applies.

  • Exact statement: This food product is not produced under license or inspected by the State of Maine.
  • No label required at all if selling directly to the consumer from your own home under the home-kitchen-producer exemption

Common Maine blockers and cautions

  • Meat or poultry products (always need state/federal inspection, in every town)
  • Shipping, mail order, wholesale, or retail-store placement without a Home Food License
  • CSA/buying-club/delivery arrangements outside a Food Sovereignty Ordinance town
